Legal Agreement and Disclaimer
JDWebHost is a division of JDProviders referred to below as JDProviders/JDWebHost. You, as a purchaser of JDProviders/JDWebHost services are referred to as the "customer".
JDProviders/JDWebHost supplies no warranty of any kind. In no case shall JDProviders/JDWebHost be liable for any costs or events that occur beyond its control including, but not limited to, hosting service outages, speed reductions, reliability, network outages, Internet connectivity problems or client side browser issues. You, the customer reading this document, understand and agree that JDProviders/JDWebHost provide services on an "AS-IS" basis.
1. Site Content and Access
JDProviders/JDWebHost has no liability for the accuracy of the content and information contained in this service, or the contents of any web pages, or for any assertions or omissions therein. The customer has sole responsible for the accuracy of the content information, photographs, and property descriptions supplied to JDProviders. JDProviders/JDWebHost can not and does not guarantee the uptime of contracted web sites on which the customers web pages reside. The uptime is very high, however, on a rare occasion the site may be unavailable due to circumstances beyond JDProviders/JDWebHost control. When that happens, it can take time to resolve the problem. During that time period you may not be able to access the site. We reserve the right to prorate a refund to you, for the absence of JDWebHost web pages only, if JDProviders/JDWebHost thinks that the down time is excessive. JDProviders/JDWebHost gets to define the term "excessive" and our definition may not agree with yours, but ours is the only one that counts. JDProviders reserves the right to remove, at any time, customer web page listings and information due to non-payment.
2. Personal Loss
JDProviders/JDWebHost is not liable for any direct, indirect, incidental, special or consequential damages resulting from the posting, distribution, use or inability to use information posted on JDProviders/JDWebHost. JDProviders/JDWebHost is not responsible for resulting interpretations, perceptions, or decisions based on content contained in JDProviders web site pages. Do not bother to contact JDProviders/JDWebHost because you, the customer, agree that JDProviders/JDWebHost is not responsible for any loss, real or perceived, that you may incur. If some court or arbitrator takes issue with this disclaimer and finds JDProviders/JDWebHost at fault then, in that case, you agree that our maximum liability will be limited to the amount that you paid us for your product or service only and no more.
3. Copyright Notice
With the exception of content provided directly by you, the customer, everything that appears on JDProviders/JDWebHost web sites, including content, services, software, graphics, and anything else transmitted through, or used with any of our sites, is owned by JDProviders/JDWebHost and you can't use it for anything unless you first gain permission, in writing, from JDProviders/JDWebHost.
4. Financial Transactions
Credit card transactions are handled by a third party that JDProviders/JDWebHost does not own or control. While there is rarely a problem, there is no such thing as "perfect security" on the Internet. JDProviders/JDWebHost is not responsible for the success or security of transactions undertaken or processed by third parties even if those transactions originated on our site.
5. Miscellaneous
JDProviders/JDWebHost reserve the right to change these Terms of Service at any time. JDProviders/JDWebHost reserve the right to modify, suspend, discontinue or restrict the use of any portion of any of our sites, or the entire site, or sites, any time that we deem it necessary.
These Terms of Service will be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflicts of law provisions. You, the customer, hereby agree that any cause of action you may have with respect to JDProviders/JDWebHost must be filed in a federal or state court located in Tampa or Clearwater, Florida, within two months of the time in which the events giving rise to such claim began, or you agree to waive such claim. You agree no such claim may be brought as a class action. If for any reason any provision of this Agreement is found unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected in that provision, and the remainder of the Agreement shall continue in full force and effect. Any failure of JDProviders/JDWebHost to enforce or exercise any provision of this Agreement or related right shall not constitute a waiver of that right or provision. The section titles used in this Agreement are purely for convenience and carry with them no legal or contractual effect. In the event of termination of this Agreement for any reason, you agree the following provisions will survive: the provisions regarding limitations on your use of Content, the license(s) you have granted to JDProviders/JDWebHost and all other provisions for which survival is equitable or appropriate.
